Oversight is done by the executive itself.  Continuous steps being made to create a surveillance structure, to which neither judiciary or parliament has oversight.  In Mar 2020 govt admitted to having used facial recognition software to identify 1100  protestors. Even as the world over there are questions about its use. 

There are three sruveillane projects, started under the UPA, so who is in power does not matter.  in 2013 when call record of Mr Jailtley were made available, the issue raised by the oppositions are what we all want.. They started central monitoring System, Netra, >>>,  which collectively and individually seek to spy on the citizens.. Internet traffic of every citizen is subject to sruveillance..  CMS is similar to the pRISm project, NATGRID.. 

  500 companies sell intrusive software worldwide... not much international regulations..  India is witness cyber attack on citizens.. the malicious intrusion is clearly illegal,  On the one hand govt says that all services like the vaccine, rations, banking, IT filling,  cannot be got without being online, and have a aadhaar, yet India has the highest number of Internet shutdowns.

And independent foreign forensic analysis states that the mailware was clearly detectable, and it seems that the Indian agencies did not make any attempt to look for it.  

Pegasus Netwire, the situation is becoming so drastic, that no body knows whether their phones are being hacked or not. and it is surveillance and planned planting over years. Then data mining issue: is worse.. We are in for very bad times.  The data protection bill is very weak,  The Indian Evidence act  hasnt moved adequately with the change in technology, how do you prove that a particular electronic document is valid or not? 

Apar Gupta – a lawyer and the Executive Director of the Internet Freedom Foundation (IFF), he has been working on. and  ssues of net neutrality, free expression, privacy and innovation. IFF has filed several petitions in the Supreme Court on Internet-related policy issues that impinge on citizens’ rights.

Control of Data was the issues in the first round of fight between the tech companies and government.. 

The uncommonly cautious wording to the preface to the Media Consortiums' admittedly limited claims is sought to be used to undermine the consortiums extraordinarily significant revelations, by it.  The consortium desisted from making seeping claims. It aid the leaked list of 50000 numbers, are believed to have been selected as those pf people of interest, by government clients of NGO group. The Consortium also said that the list indicates the potential targets who are idenitified in advance by the NSOs clients for possible surveillance.  The list is only an indication of intent. 

But.. the consortium has said "The forensic examination of a small sample of mobile phones, with numbers on the list found tight correlations between the time and the date of a  number in the data and the start of Pegasus activity. In some cases  in some cases a a few seconds. "

The fact that out of the 300 Indian numbers in the list , already 20 of them were forensically examined, and found to be either successfully infected or attempted to be penetrated.  That is enough of a case for a comprehensive investigation in India.

The NSO’s “customers” and Pegasus spyware licensing

The OSY Technologies s.a.r.l, NSO Group’s subsidiary, had a legal audit done by a law firm in the wake of the 2019 controversy around the spyware being used through the WhatsApp messenger. The report stated that the “Human Rights Policy and attendant governance documents” of the OSY Technologies s.a.r.l and its subsidiaries are in sync with the “United Nations Guiding Principles on Business and Human Rights”.

This report stated:

“We license our products only to vetted and legitimate government agencies for the sole and exclusive use in preventing and investigating serious crime, including terrorism. We never use or participate in the use of our products and we have no access to personal data used in or generated from their use… We do not operate our products ourselves or on behalf of our customers; our role is limited to the provision of technical support and maintenance services to our customers. (sic)”

This means, to hack a phone and continue with snooping, the government agency must operate the Pegasus spyware itself and deploy it. In that case, it will have to first get a license to use the application, which is granted by NSO only after the Ministry of Defense approves such a deal. .. the “MoU on Cyber Security Cooperation between India and Israel” states that it “also envisages collaborating in the field of cyber security resilience…”, ...a category in which NSO group’s Pegasus spyware fits well.
