Human Rights Defenders Data Information Knowledge Solidarity

HRDs  must counter State's offensive of intimidating ordinary people, from expressing their opinion on social media or on various issues .  Lawyers as well as Journalists, and youtubers bring these cases up in the public eye in order to youth to feel more secure speaking out.. This series we will document  case law  as well as reports through links to documents, reports from various websites and Blogs and Posts of HRDs. This is also an attempt to publicise all the dirty tricks State  have been using. This is a contributory effort..

From a WA post: On January 3, 2025, NIA Court Special Judge Vivekanand Sharan Tripathi (V.S. Tripathi) convicted 28 accused from the Muslim community and sentenced them to life imprisonment in the brutal murder of Abhishek alias Chandan Gupta from Kasganj on January 26, 2018. This gruesome murder was committed by people from the Muslim community during Chandan's Tiranga Yatra.

Apart from the life sentence, Justice Tripathi has raised another important issue in his judgment and that is the willingness of expensive lawyers to represent anyone for money! This issue has never been commented on by any Supreme Court or High Court judge till date.

While pronouncing the sentence, Justice Tripathi raised questions on the role of national and foreign NGOs involved in defending criminals and has sent a copy of his order to the Union Home Ministry and the Bar Council of India to curb them.

 Unethical NGOs and  lawyers.

The Supreme Court has ignored this till date but a trial court judge has dared to expose this conspiracy and unholy alliance.

On January 3, 2025, NIA Court Special Judge Vivekanand Sharan Tripathi (V.S. Justice Tripathi said in his order, “There is a need for a thorough investigation into where and who is funding these NGOs, what is their ultimate objective. It is alleged that whenever a terrorist is caught, such NGOs immediately provide very expensive lawyers to defend him. This is a matter of national security concern.”

The court has named the following 7 NGOs/organizations in its order.

1. Citizens for Justice and Peace, Mumbai

2. People’s Union for Civil Liberties, Delhi

3. Rihai Manch

4. Alliance for Justice and Accountability, New York

5. Indian American Muslim Council, Washington DC

6. South Asia Solidarity Group, London

7. Jamiat Ulema Hind

Justice Tripathi’s order is truly historic and he has made a similar demand to the govt. The fees of lawyers practicing in the High Court and the Supreme Court should be available in the public domain and their asset declarations should also be published for public information. They should also declare how much income tax they have paid every year; Lawyers’ fees should be collected only through cheque/banking channels; Affidavits should be sought from the top lawyers of the Supreme Court regarding the receipt of lawyer fees as to who paid their fees, so that it becomes clear whether any terrorist organization was funded or not.

This historic order of Justice Tripathi should be welcomed and supported by all patriotic Indians!

Advocate Ashwini Upadhyay's petition seeking deportation of Rohingya Bangladeshi infiltrators has been pending since 2017.

Six high-ranking lawyers appeared in the Supreme Court for two Rohingyas, Mohammad Salimullah and Mohammad Shakir, who looked like beggars and lived in squalid conditions. These lawyers were - Dr. Rajiv Dhawan, Prashant Bhushan, Dr. Ashwini Kumar, Colin Gonsalves, Mayat Fali Nariman and Kapil Sibal.

Advocate Ashwini Upadhyay's petition to stop forced conversions is being opposed by 10 expensive top lawyers.

22 top lawyers are seen opposing Upadhyay's petition challenging the Places of Worship Act. These include MPs, MLAs and former Law Ministers, Home Ministers, External Affairs Ministers and Education Ministers.

The petition is still pending for a long time due to such top lawyers.

Only in October 2024, another NGO - Social Jurist filed a petition in the Delhi High Court and sought an order from the Centre to allow "children of Rohingya refugees" to enter public schools.

When the High Court dismissed the petition saying that Rohingyas are foreigners and do not have legal permission to enter the country and are a threat to the security of the country, this NGO reached the Supreme Court and SC said that Rohingyas' children would be provided with education. 

There are many such lawyers and NGOs, the funding of all of them should be investigated.

For the sake of the country, please forward this message as much as possible, so that the autocratic and insensitive judiciary becomes accountable to the people.🙏🏻🙏🏻

AiNNI [ All India Network of NGOs and Individuals Working with National and State Human Rights Institutions] ] stands along with the larger vibrant, vocal, non-compromising yet patriotic citizenry of this country whose stand has been vindicated through the report and recommendations of the 45th Session of the Sub Committee on Accreditation (SCA) of Global Alliance of National Human Rights Institutions (GANHRI) held March 2025 made public last night. 


The decision to downgrade NHRC to ‘B’ status is historically the first downgrading of the Indian NHRC since its inception in 1993 and after its 2016, 2023 and 2024 deferrals. NHRC has challenged these recommendations under the GANHRI statute. 

AiNNI hopes NHRC will upload this report on its website truly respecting the human rights principles of transparency and accountability. 
AiNNI wishes to also record the small yet positive steps undertaken by the Indian NHRC, for the first time in history, under the leadership of Justice V. Ramasubramanian and wishes to express its willingness to work with and support the NHRC as a responsible civil society platform which has engaged with the NHRC ever since its inception as a platform in 2010 and through its forerunner, People’s Watch since 1995. 
AiNNI wishes to place its gratitude to the SCA and GANHRI for this very fair and detailed assessment that it has undertaken and we do hope that this will path the way for a yet a stronger, independent, truly effective NHRC that this country badly requires.
