The Centre on Wednesday vehemently defended its right to appoint the chief election commissioner and election commissioners and told the court that Constitutional silence cannot be filled by the judiciary in response to the Supreme Court's observation that "silence of the Constitution" on the procedure and qualification for appointment of the CEC and ECs was exploited by successive governments. It agreed that it should respect the executive's independence by staying out of its territory.
